Legal & Policies
These Terms and Conditions ("Terms") govern your access to and use of the website, marketing diagnostics, strategic deliverables, coaching calls, and related services (collectively, the "Services") offered by Blue Marz Group, LLC, doing business as FoundryX. By purchasing, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
FoundryX provides fractional CMO and marketing strategy services to home service and franchise businesses, including but not limited to the Marketing Diagnostic, Marketing Game Plan, Marketing Leadership Sprint, Fractional CMO Retainer, and Advisory Membership (collectively, the "Offerings"). The scope of each Offering is described at the point of sale and may be updated by FoundryX from time to time.
FoundryX provides strategic marketing guidance, analysis, and leadership. FoundryX does not build websites, manage advertising accounts, create content, or execute marketing campaigns directly, unless separately agreed to in writing.
Marketing outcomes depend on factors outside FoundryX's control, including your business's execution, market conditions, vendor performance, and competitive landscape. FoundryX does not guarantee specific results, including but not limited to lead volume, revenue, booking rates, or return on investment. Any figures, benchmarks, or examples referenced in the Services are illustrative only and are not a promise of similar results for your business.
To deliver the Services, FoundryX may require timely access to your analytics, advertising accounts, Google Business Profile, CRM, and other business systems, along with accurate and complete information about your business. Delays or inaccuracies in the information or access you provide may affect the timeline or quality of the Services. You are responsible for the decisions you make and the actions you or your vendors take based on FoundryX's recommendations.
Marketing Diagnostic ($79): If you do not find the Diagnostic valuable, you may request a full refund. No questions asked.
Marketing Leadership Sprint: If, by Day 30 of your Sprint, you do not feel you are receiving strategic value that justifies the investment, FoundryX will refund the remaining balance of your engagement. You keep all work product completed to that point. This guarantee applies only within the first 30 days of the engagement.
Fractional CMO Retainer and Advisory Membership: These are month-to-month engagements. Either party may cancel with 30 days' written notice. Fees already paid for services rendered are non-refundable.
Marketing Game Plan: Purchases are final and non-refundable unless otherwise stated in writing at the point of sale.
FoundryX reserves the right to update pricing for future purchases at any time. Pricing in effect at the time of your purchase or booking governs that engagement.
All frameworks, templates, methodologies, scoring systems, and proprietary tools used by FoundryX to deliver the Services (including the FoundryX Marketing Score and the FoundryX Operating Plan template) remain the sole property of Blue Marz Group, LLC.
Upon full payment, you receive ownership of the completed, customized deliverables produced specifically for your business during your engagement (including your finished Operating Plan, audit findings, and related written materials). FoundryX retains the right to continue using, refining, and applying its underlying frameworks and templates for other clients.
You may not resell, license, or represent FoundryX's proprietary frameworks or methodologies as your own for commercial purposes.
In the course of the Services, you may share confidential business information with FoundryX, and FoundryX may share strategic recommendations and work product with you. Both parties agree to keep the other's confidential information private and to use it only for purposes of the engagement, except as required by law.
FoundryX provides services as an independent contractor, not as your employee, partner, joint venturer, or agent. Nothing in these Terms creates an employment, partnership, or agency relationship between you and FoundryX. FoundryX does not direct or control your vendors' work and is not responsible for vendor performance, though FoundryX may make recommendations regarding vendor accountability.
To the fullest extent permitted by law, Blue Marz Group, LLC and its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business opportunities, arising out of or related to your use of the Services. FoundryX's total liability for any claim arising from the Services is limited to the amount you paid for the specific Offering giving rise to the claim.
By providing your contact information in connection with a purchase, booking, or form submission, you consent to receive email and, where opted in, SMS/text communications from FoundryX related to your purchase, service delivery, account matters, and — where you have separately consented — marketing and promotional messages. Message frequency varies; message and data rates may apply. Text HELP for assistance or reply STOP to opt out of SMS at any time. You may unsubscribe from marketing emails at any time using the unsubscribe link included in the email or by contacting us at [email protected]. Transactional and service-related communications may still be sent as necessary to deliver the Services.
Our collection and use of personal information is described in our Privacy Policy. By using the Services, you acknowledge that you have read and understood our Privacy Policy.
You must be at least 18 years old to purchase or use the Services. By completing a purchase or booking, you represent that you have the authority to bind the business on whose behalf you are acting.
We may update these Terms from time to time. The updated version will be posted with a revised effective date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising under these Terms is subject to the jurisdiction of the courts located in Tarrant County, Texas.
